"The Florida Department of Environmental Protection (DEP) has re-opened the criminal investigation of illegal dumping of county fill dirt at the Howerton Farm, located at 880 Farm Road in Sebring, and is now claiming exemptions to specific public records because of that investigation.
In a letter dated Jan. 9, Tracey Hartman, senior attorney with the DEP, stated "regarding the 'Howerton pit' site, the agency asserts that information contained in the documents...are exempt from production pursuant to section 119.071(2)(c)1., Florida Statutes. The exempt material is part of an ongoing criminal investigation of an identifiable person or group of persons which has been compiled by the agency in the course of conducting a criminal investigation," said Hartman."
