Senate Bill 185 was introduced by Sen. Charles Copeland (R-West Farms) in December 2007. Concurrently, House Bill 338, identical to SB 185, was introduced by Rep. Greg Lavelle (R-Sharpley).

The bill requires the creation of a searchable online database of all contracts entered into by all school districts and charter schools. It is part of the Delaware Taxpayer Coalition's 2008 Fiscal Transparency Package.

The Department of Education, in conjunction with the Office of Management and Budget, will create and run the site. It must include all contracts entered into on and after the effective date of the act. Each contract must include a synopsis of its bidding process, be posted within 30 days of execution, and remain online at least 10 years.

Additionally, the site must include the following information:

  • Name and principal location of those receiving funds
  • Amount of funds expended
  • Name of funding/expending agency
  • Name of funding source
  • Budget program/activity of expenditure
  • Purpose of the funding action
  • Expected performance outcome of funding
  • Past performance outcomes for the funding/expenditure
  • Any other information deemed relevant by the Department of Education

The act will be effective six months after its enactment into law.

Senate Bill 185 was assigned to the senate finance committee on 01/09/08, and has yet to be acted on. [1] The House Bill passed out of administration committee on 04/23/08.[2]
