Former Chattanooga councilman guilty of obstructing justice

Former Chattanooga city council member John P. "Duke" Franklin Jr. pleaded guilty to one count of obstructing justice. Franklin resigned his seat earlier this year, shortly after being arrested in conjunction with a local cocaine ring. Charges of money laundering and lying to federal agents were dropped.[1]

[edit] Indictment
According to the indictment, Michael Kelly, co-defendant in the case, needed help hiding the origin of nearly $70,000 in drug money that was seized during a traffic stop in March. Kelly found someone to provide a document saying Kelly was loaned the money, and Franklin agreed to create a fake document for the non-existent loan.[2]
With the look of legitimacy to the loan papers, Franklin figured the money would be returned to Kelly. Officials say that when Franklin was questioned about his involvement in the scheme he lied about the papers.[1]
[edit] Cocaine Ring
Last April and May, 42 people, including the councilman, were arrested as part of a drug investigation. They were accused of taking part in an operation that was distributing at least 30 kilograms of cocaine a month in Chattanooga.[1]
Franklin was never accused of selling drugs, but in court he testified to having a drug problem and had completed a 28 day rehab program.

While Franklin's plea agreement is sealed, federal sentencing guidelines could net him up to five years in jail and a $250,000 fine. Sentencing is set for February 25.[2]
