This practice is controversial because public funds are spent to lobby for an agenda not subject to direct approval by voters, and outcomes may be contrary taxpayers benefit.

The State Board of Higher Education instructed university personnel to use taxpayer resources to campaign against North Dakota Income Tax Cut, Measure 2 in 2008.[1] Initiated measures may put on the ballots, funded by taxpayer dollars. This happened because of a loophole in North Dakota state law that disallows the use of taxpayer resources to campaign against a candidate or political party, but does not explicitly name initiated measures put on the ballots through the support of the taxpayers.[2]
