Sheriff is an elected position in the state of Texas according to the state's constitution.

The state constitution mandates that the duties, qualifications, perquisites, and fees of office, will be decided by the legislature. Should there be a vacancy, the Commissioners Court will appoint a temporary sheriff until the next general election.[1]
