[edit] Background

Times-Journal, Inc., d/b/a Marietta Daily Journal v. Cobb County, et al., No. 89-16974-05 (Cobb County Superior Court, Oct. 23, 1989) (Cauthorn, J.): Suit by the Marietta Daily Journal for an order requiring the defendants to allow the Journal to inspect and copy the minutes and a tape recording of the September 26, 1989 meeting of the Cobb County Board of Commissioners. Judge Cauthorn ruled that the Journal was entitled to the requested relief as the meeting should not have been closed because more than discussion and deliberation of a personnel matter occurred, i.e., a vote was taken.[1]
