Wiggins v. The Bd. of Comm'rs of Tift County , Ga. , 258 Ga.App. 666 (2002) (Eldridge, J.): Plaintiff sought injunctive relief under the Open Meetings Act against the Board of Commissioners of Tift County. He claimed that the Board received evidence and heard arguments against him while in a closed session in violation of the Act. The superior court granted the injunction and ordered the relief sought by Plaintiff -- that no action taken against him as a result of the Board meeting.

The Court of Appeals affirmed the remedial injunction but also held the trial court should not have placed the Board under a continuing injunction as the Board was already under a legal duty to comply with the Open Meetings Act. ^[1]
